Dear Charles and Teena:

As we discussed last Thursday night, the Board of Directors met on January 25, 2007, to discuss a request from Mike and Karen Joyce that the Board rescind its June 2006 approval of your pool deck and screened enclosure for the reason that they extend beyond the 40 foot width of your new home on lot 6. Enclosed for your information are the minutes of that meeting.

As you will see, the Board did not take a vote on whether or not to rescind approval of either the deck or the enclosure pending consultation with an attorney and/or our liability insurance carrier regarding the feasibility of various decision options and the related risks and consequences to the Board and the association. This process is now underway and we would hope to render a decision in the near future. In the meantime, we on the Board would ask that you not begin construction of the portion of the pool enclosure that extends beyond the house line. In addition, to the extent feasible, we would appreciate your limiting further significant construction on the portion of the pool deck extending beyond the width of the house.
