HOMEOWNER’S ASSOCIATION SPECIAL MEETING FEBRUARY 2, 2010 5:00PM @ THE
HOME OF SARA AND HAROLD CLARKE Members
in attendance: Susan & Gary Fairley, Karen & Mike Joyce, Charles Weiss,
Dave Miller, Bob Rohr, Frank Carelli, & Harold Clarke. Board
Members present, President Bob Hamby, Vice President Sara Clarke, Treasurer
Steve Robinson, Operations Peter Healey, and Secretary Larry Amuso. The
President called the meeting to order at 5:00PM and asked for a proof of
notice. The Secretary advised that the meeting notification was placed on the
bulletin board at the pool, and listed on the Web page and sent by e-mail to
all e-mail recipients. Upon acceptance
the President announced the purpose of the meeting, i.e., to discuss the pool
installation at 23 Ocean Dune Circle and added that the meeting will be limited
to that subject. The Board is to address paying the submitted attached invoice
presented by Amenity Pools. The President explained the
situation from its inception, receipt of e-mail from the Deforest inquiring
about the necessities for installing a pool and fence. He, thereby, brought all
in attendance up to date of his knowledge of what has transpired. He then opened the floor to discussion. Gary
Fairly presented his views and sentiments advising that he and his wife were
not consulted to the extent that it has been purported to be, stating that they
had never discussed the situation with the Deforests. Steve Robinson responded and
explained his role and work along with Sara Clarke and the Association lawyer
Dennis Bayer and that attempts were made to communicate to all involved to
bring this situation to an amicable end. There apparently had been some
miscommunication. Steve Robinson apologized for any communication or lack
thereof that may have slighted anyone. The situation was one of much
interaction and communications involving active participation, by e-mail,
telephone, and direct conversation of the past President, the present
President, Sara Clarke, Steve Robinson, Peter Healey, Susan & Gary Fairly,
Joe and Laura Deforest, Dennis Bayer, and the Pool Contractor. The issues involved were: the fence
(position & height) which will obscure the equipment, removal of the pool
equipment to the North side of the house or pool equipment remaining where it
had been installed but to move it ten feet closer to the house (which was
done). The height of the pool equipment was not arguable since FEMA regulations
require some of the equipment to be a certain height above ground. The item of
planting shrubbery and its location was also mentioned. The President presented the invoice
for discussion. Steve Robinson moved that the Board consider the invoice. Larry
Amuso 2nd. The invoice
consists of a charge of $2,525.00. President Hamby moved to amend to pay
$1,300.00. Sara Clarke 2nd.
The amendment passed. All correspondence that took place
